The Company may obtain the following types of information from or concerning you or your mobile phone device, which may include information that can be used to identify you as specified below (“Personally Identifying Information”):
When you delete your User Submissions, they will be removed from the Johnny on the Spot Service. However, you understand that any removed User Submissions may persist in backup copies for a reasonable period of time (but following removal will not be shared with others) or may remain with users who have previously accessed or downloaded your User Submissions.
Other users of the Johnny on the Spot Service may see your User Submissions in a way that is consistent with the use of the Johnny on the Spot Service. The Company does not sell or share your Personally Identifiable Information (such as mobile phone number) with other third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. The Company may share your Personally Identifiable Information with third party service providers to the extent that it is reasonably necessary to perform, improve or maintain the Johnny on the Spot Service. The Company enters into relationships with a variety of businesses and works closely with them. In certain situations, these businesses provide services to you, sell items or provide promotions to you through the Johnny on the Spot Service. In other situations, the Company provides services or sells products jointly with these businesses. You can easily recognize when one of these businesses is associated with your transaction, and the Company will share your Personally Identifying Information that is related to such transactions with that business. The Company may share non-personally-identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, asset views, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions and/or functionality on the Johnny on the Spot Service. The Company may collect and release Personally Identifiable Information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with national laws (such as E.U Copyright Law) or international law (including laws outside your country of residence) or to respond to a court order, subpoena, or search warrant or equivalent, or where in the Company's reasonable belief, an individual's physical safety may be at risk or threatened. The Company also reserves the right to disclose Personally Identifiable Information and/or non-personally-identifiable information that the Company believes, in good faith, is appropriate or necessary to enforce the Company's Terms of Service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Johnny on the Spot Service or the Company's servers, and to protect the rights, property or safety of the Company, the Company's employees or users or others. The Company's release of Personally Identifying Information under the conditions described in this paragraph may include exchanging information with other companies and organizations (including outside of your country of residence) for fraud protection and credit risk reduction.
The Company uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your personal information. The Company cannot, however, ensure or warrant the security of any information you transmit to the Company and you do so at your own risk. Using unsecured wifi or other unprotected networks to submit User Submissions through the Johnny on the Spot Service is never recommended. The Company makes commercially reasonable efforts to ensure the security of the Company's systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of the Company's physical, technical or managerial safeguards. If the Company learns of a security systems breach, then the Company may attempt to notify you electronically so that you can take appropriate protective steps. The Company may post a notice through the Johnny on the Spot Service if a security breach occurs.
Protecting the privacy of young children is especially important. For that reason, the Company does not knowingly collect or maintain Personally Identifiable Information or non-personally-identifiable information on the Johnny on the Spot Service from persons under 16 years of age, and no part of the Johnny on the Spot Service is directed to or intended to be used by persons under 16. If you are under 16 years of age, then please do not use the Johnny on the Spot Service at any time or in any manner. If the Company learns that Personally Identifiable Information of persons under 16 years of age has been collected on the Johnny on the Spot Service, then the Company may deactivate the account and/or make the User Submissions inaccessible.
In the event that the Company is acquired by or merged with a third party entity, the Company reserves the right to transfer or assign the information the Company has collected from its users as part of such merger, acquisition, sale or other change of control. In the unlikely event of the Company's bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors or the application of laws or equitable principles affecting creditors' rights generally, the Company may not be able to control how your personal information is treated, transferred or used. If the Company or substantially all of its assets are acquired, or in the unlikely event that the Company goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party.
